Last saturday a lady ran a red light and totaled my truck. Well OK, it happens. Nobody got hurt and that's what's important. All was going well with her insurance company (Allstate) and they immediatly offered me a rental car to which I said yes. I picked it up last night but had a small problem with insurance. I only had my truck covered with liability (it's a 86 you know) and they needed full coverage. Would I like to pay for it. Call Allstate I said. They should have to pay for it. She hit me remember. They did and all was well. Today however, the rental guys called me at work and said "Allstate" was now refusing to pay for the insurance on the rental car and would I like to pay for it." In a pigs ear I said. Come and get the (explicative :cuss: ) car. I then e-mailed the Insurance Commissioner of our great state of Washington (Washington the state, not DC) about what happened. Guess we'll see there.
Here's what it boils down to IMO. I believe "Allstate" is trying to get out of paying for a rental car for me by pulling a fast one. They say they don't have to insure the rental, I do. Bull Crap sez I. See hit me, she got the ticket, she is 100% responsible, you're her insurance company, you pay for it all and that's that. What do you think?

I think you should be very careful when dealing with them, might not hurt to "talk" to a lawyer.

I know here in Oklahoma the other persons insurance had to pay fully since she was the one that hit my daughter, She had the rental car until they paid off her van and she got another one.

Update: Well, I talked to my insurance company and it seems they can do that. By law they have to provide a vehicle. Not the gas or the oil... or the insurance either. I guess I'm not surprised. Sickened a little but not surprised. After all, they're an insurance company. They could provide the insurance for the car for nothing. No skin off their nose. Guess it makes them feel big and powerful. 'nuf said
2nd update: It's getting curiouser and curiouser. I just recieved a reply from the insurance commissioner which says, "I am unaware of any prescriptive insurance law or regulation that specifically addresses the issue. blah, blah However, it might be argued that were it not for the Allstate drivers negligence you would not have been required to rent a car in the first place. You might want to have Allstate explain what WA statute (law) or WA case law it is referencing to support denial of responsibility. If they refuse, please fill out the attached request for assistance form. We would be able to make an inquiry on your behalf after you complete and sign the request."
Now ain't that somethin'. The Ins. Commissioner said "Huh?"

Talked with Allstate again. When I asked what law they used to justify not providing insurance for the rentals he said, "I try to avoid it mostly" and "how we get away with it is by paying the persons $20 dollars a day for their lack of a car. So we're giving you 7 days and you'll get a check for $140 dollars." I am just so excided. $140 bucks! May they burn in hell. I'm sending in the request for Assistance to the insurance commissioner. Might not help but it couldn't hurt. Speaking of hurt :gun:

Just an update. Here's the plan. I took a week off to heal and all "seems" to be well now. No aches or pains. Now, the insurance co. already offered to pick up my medical and give me $500 dollars to boot so I figure I'll let them stew for a while. See what comes up. They are usually really hot on closing a claim and since I'm 99% positive I'm OK, I think I'll wait and see if they will "magically" offer me more. You know, trying to sucker me into closing. After they pay medical I figure they owe me lost wages and then some. Maybe I'll pick up a tidy little chunk of change! :whistle: We'll see.
